Terms and Conditions

1) The prize draws

A) The prize draws will run from the opening dates and until the closing dates specified on the website at dailyguitardraw.com (the “Website“). These dates shall be referred to as the “Opening Date” and “Closing Date”, respectively. Times and dates referred to are for London, England.

B) To be in with a chance of winning, everyone who enters a prize draw (an “Entrant”) will be required to correctly answer a question (the “Entry Question”) set by Daily Guitar Draw (Crimson Guitars Limited) (“the Promoter“). The Entry Question is on each individual prize listing on the Website and will correspond to that prize only.

 

2) Entry

A)i) Entry to a prize draw can be made via one of two routes: (1) via purchase of a ticket from the Website, the price for which shall be stated on the Website, ii)  via the free postal entry route (see paragraph 2.Ci). below),

B) By submitting an entry via any of these routes, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions.

C) Free entry route. Entry for free by post (“Postal Entries“):

Ci)  To enter prize draws via post for free users must write their USER ID, the name of the prize draw which they are entering, and the answer to the corresponding Entry Question (option A, B, or C) on a postcard and send the postcard/s by 1st or 2nd class post to the following address:

Multiple postal entries for different user profiles from the same person/ household have the right to be rejected by the Promoter. Postal entries must be sent by yourself and for your User profile only.

Cii) Entrants must have registered an account on the Website to receive their USER ID.

(Postal Entries are not for sale and can be made free of charge)

Ciii) It is the Entrant’s responsibility to ensure that the required details are set out on the Postal Entry in a legible manner, and that they are sent to the Promoter’s address as set out in paragraph 2.Ci) above.

Civ) The Promoter reserves the right to reject Postal Entries that do not comply with all the conditions of this paragraph 2.Ci).

Cv) The Promoter accepts no liability for any postal delays, lost or damaged entries, and or any event or circumstance beyond the Promoter’s reasonable control).

Cvi) Postal entries are limited to one entry per person for each competition

 

3)  Eligibility

A) The Entrant must not be physically located (at the time of entry to the prize draw) in a jurisdiction where it is unlawful to enter into the prize draw.

B) In using the Promoter’s services, you represent and warrant that you are not physically located in and are not a resident of a jurisdiction where it is unlawful to host and/or participate in such a prize draw at the time when you use the Promoter’s services.

C) The Entrant must be aged 18 years or over.

D) The following people may not enter the prize draw:

D.i) employees or shareholders of the Promoter (including Crimson Guitars, Daily Guitar Draw, Dorset Guitar Museum) or its holding or subsidiary companies.

D.ii) Employees of agents or suppliers of the organisations referenced in paragraph 3.d.i above or their holding or subsidiary companies, who are professionally connected with the prize draw or its administration;

E) By entering the prize draw, an Entrant is deemed to confirm that they are eligible to do so and eligible to claim the Prize they may win (please see paragraph 4 below). The Promoter may require an Entrant to provide proof that they are eligible to enter the prize draw.

F) The Promoter will not accept entries that are:

  • made by way of a joint submission or on behalf of another person;
  • automatically generated by computer;
  • completed by third parties or in bulk; and, or,
  • have been altered, reconstructed, forged or tampered with.

G) The Promoter reserves all rights to disqualify any Entrant or winner if their conduct is contrary to the spirit or intention of the prize draw.

H) Customer profiles are limited to one per person and the promoter reserves rights do disqualify user’s entries with multiple accounts under the same name and/ or registration.

 

4)  The prize

A) The prize for the relevant draw is as described on the relevant prizes page (the “Prize”). The specific prize will be listed next to each ticket sold on an individual listing. The ticket will only allow entry into this competition. Details of the Prize are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date.

B) The Promoter reserves the right to substitute the prize with a prize of equal or greater value. If any details of the Prize change, the Promoter will endeavour to update the Website as soon as reasonably possible.

C) The Promoter makes no representations and gives no warranties about the Prize, its value, its condition or any other information provided on the Website. The Promoter makes no representations and gives no warranties that the information provide on the Website is accurate, complete or up to date.

D) The Prize may be supplied by a third-party supplier (the “Supplier”). Details of the Supplier (if any) will be provided on the Website.

E) The Promoter reserves the right to substitute the Prize for an alternative cash prize (“Cash Prize”) in the following circumstances:

      1. the Prize becomes unavailable;
      2. other circumstances beyond the reasonable control of the Promoter make it necessary to do so.

 

5) Winners

 

A) Each Entrant that correctly answers the Entry Question corresponding to the periodic prize draw and otherwise complies with all of these terms and conditions of entry, will be entered into that prize draw.

B) There will be a livestream held once a week whereby each prize draw will be made using Google’s random number generator. The footage for this will be posted onto the Daily Guitar Draw (Crimson Guitars) YouTube channel where it will stay (hard copies will be kept on file by the Daily Guitar Draw). The decision of the Promoter is final, and no correspondence or discussion will be entered into.

C) The Promoter will publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will (in accordance with the Privacy Policy set out on the privacy policy page of the Website) publish the name of the Prize winner (as set out in the winner’s profile) within 14 days of the Closing Date.

D) As soon as practical after the relevant prize draw has occurred in accordance with paragraph b the Promoter will send an email to the winner of that prize draw. The winner of each prize draw will be published on the winner’s page on the Website, which will be updated within two working days of each live stream draw. Winners will also be able to find the relevant livestream to check the draw and if they have won.

E) It is the entrant’s responsibility to check the winner’s page on the Website or the livestream to find the result of the prize draw.

 

6)  Limitation of liability 

A) Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

 

7)  General

A) If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, exclude an Entrant from participating in any current or future promotions and, in addition, the Promoter may at its sole discretion ban an Entrant from using the Website.

B) The Promoter reserves the right to hold, void, suspend, cancel, or amend any prize draw or promotion where it becomes necessary to do so.

C) Service level and interruption

C.i.) You accept that on occasion there may be interruptions to the Website for scheduled maintenance or upgrades, or emergency repairs, or due to failure of telecommunication services and equipment which are beyond the Promoter’s control.

C.ii.) The Promoter will use reasonable efforts to ensure that the Website remains available for you to access and use in accordance with these terms and conditions. However, you acknowledge that the Promoter does not guarantee that the Website will be available at all times or be error or interruption free.

8)  Claiming the prize

A) The winner must claim the Prize personally. The Prize may not be claimed by a third party on the winner’s behalf. Details of how the Prize will be delivered to the winner (or made available for collection) are published on the Website.

B) The Prize will be delivered to the winner’s registered address for free as part of the Prize. The winner will be liable for any extra tax they incur as a result of winning the prize.

C) If your personal details, including contact information, change at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to [email protected]. Notifications must include details of the prize draw you have entered, your old details and your new details. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.

D) Any Cash Prize will be transferred directly to the winner’s nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 6 weeks of the Closing Date will result in disqualification from the prize draw and the winner forfeiting the Cash Prize. In such circumstances, the Promoter reserves the right to offer the Cash Prize to another eligible Entrant randomly selected from the correct entries that were received before the Closing Date.

E) The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the Prize.

F) On selection of the prize draw winner the winner will be contacted via email and then by the phone number on record. If the prize is not claimed within 2 months of the winner being announced the prize will be reissued into Daily Guitar Draw stock and relisted/ sold accordingly. A portion of these profits will go towards the Dorset Guitar Museum. 

 

9) Data protection and publicity

A) The Promoter will only process your personal information as set out in our Privacy Policy. See also paragraph 5 of these terms and conditions about the announcement of the winner.

 

10)  The prize is not negotiable or transferable.

Prizes are not negotiable or transferable apart from when a cash alternative is offered. The customer will be contacted via email and then phone when cash alternatives are offered.

 

11)  Publicity, Advertising and Marketing

A) We would very much appreciate it if the winner would agree to send a photograph of or share on their social media a picture or video of them receiving the Prize. Anyone who does this will get a free entry into another competition which will be sent via email as a coupon.

B) Each winner agrees that the Promoter may use their name, picture, or likeness for any advertising, publicity, or other business purpose at any time for a period of five (5) years after the Closing Date. The use of the winner’s name, picture, or likeness shall not be deemed to result in any invasion of the winner’s privacy, or in violation of any property right the winner may have; and the winner shall receive no additional consideration if their name, picture, or likeness is so used. The winner further agrees that any negatives, prints or other material for printing or reproduction purposes prepared in connection with the use of their name, picture, or likeness by the Promoter shall be and are the sole property of the Promoter.

C) If you object to your name and information being published or made available, please contact the Promoter via email ([email protected]) before the Closing Date.

D) By agreeing to receive SMS marketing and entering your phone number into the text box at checkout you consent to receive marketing text messages (such as [promotion codes] and [reminders]) from [Daily Guitar Draw] at the number provided, including messages sent by autodialer. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You can unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available) in one of our messages.

E) By subscribing on our website and entering your email address you agree to receive marketing emails such as [promotion codes] and [reminders] from [Daily Guitar Draw] at the email address provided. Consent is not a condition of any purchase. Message frequency varies. You can unsubscribe at any time by replying STOP or clicking the unsubscribe link at the top of our emails.

12) Mobile Terms of Service

The Daily Guitar Draw mobile message service (the “Service”) is operated by Daily Guitar Draw (“Daily Guitar Draw”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Daily Guitar Draw’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Daily Guitar Draw through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include specials, promotions, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Daily Guitar Draw. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. If you have subscribed to other Daily Guitar Draw mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

13)  Data Protection Notice

A) Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the prize draw and fulfil the Prize where applicable. In order to process, record, and use your personal data the Promoter may disclose it to: (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. To process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
